Public Offer

This document is an official public offer (hereinafter – “Offer”) of the online store https://vivien-flowers.com.ua/ (hereinafter – “Online Store”). Acceptance of this Offer signifies the agreement of the client (hereinafter – “Buyer”) to the terms outlined below.

1. General Provisions

1.1. This Offer is an official proposal by the Online Store to enter into a contract for the sale of goods remotely, i.e., through the Online Store.
1.2. By placing an order on the Website, the Buyer agrees to all the terms of this Offer.

2. Subject of the Contract

2.1. The Online Store undertakes to transfer ownership of the goods selected and ordered by the Buyer on the Website to the Buyer, and the Buyer undertakes to pay for and accept the goods in accordance with the terms of this Offer.

3. Order Placement Procedure

3.1. The Buyer places an order through the Website by filling out the appropriate order form.
3.2. After placing the order, the Buyer receives confirmation at the specified email address.

4. Payment Procedure

4.1. The Buyer may pay for the order using one of the payment methods offered on the Website.
4.2. The cost of the goods is indicated on the Website at the time of placing the order.

5. Delivery of Goods

5.1. Delivery of the goods is carried out to the address specified by the Buyer.
5.2. The delivery time is indicated on the Website during the order placement.

6. Return of Goods

6.1. According to the Law of Ukraine “On Consumer Rights Protection,” live plants, including cut flowers and indoor plants, are non-returnable and non-exchangeable as they are classified as perishable goods.
6.2. All other goods of proper quality may be returned or exchanged within 14 days from the date of receipt, provided they have not been used, retain their original appearance, packaging, labels, and are accompanied by a receipt.

7. Refunds

7.1. Refunds are possible only in cases where the seller is unable to fulfill the order.
7.2. Refunds are made to the bank card used for payment.
7.3. Refunds are processed within 7 business days from the confirmation of the inability to fulfill the order.

8. Warranties and Liability

8.1. The Online Store guarantees the quality of the goods in accordance with the description on the Website.
8.2. The Online Store is not liable for losses incurred by the Buyer due to improper use of the goods.

9. Force Majeure

9.1. The Online Store is not liable for failure to fulfill its obligations under this Offer if such failure results from force majeure circumstances, such as war, strikes, floods, earthquakes, other natural disasters, fires, actions of authorities, or other circumstances beyond the control of the Online Store.

10. Confidentiality

10.1. The Online Store undertakes not to disclose information received from the Buyer.
10.2. The Buyer’s personal data is processed in accordance with the Online Store’s Privacy Policy.

11. Other Conditions

11.1. All disputes and disagreements arising in connection with the performance of this Offer shall be resolved through negotiations.
11.2. If a dispute cannot be resolved through negotiations, it shall be subject to consideration in the court at the location of the Online Store.
